Recipients of personal data

As part of our business activities, we work with various external entities. In some cases, it is also necessary to transfer personal data to these external entities. We only pass on personal data to external entities if this is required in the context of fulfilling a contract, if we are legally obliged to do so (e.g., passing on data to tax authorities), if we have a legitimate interest according to Art. 6 Para. 1 lit. f GDPR in passing it on, or if another legal basis allows the data transfer. When using processors, we only pass on our customers' personal data on the basis of a valid contract for order processing. In the case of joint processing, a joint processing contract is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke a consent you have already given at any time. The legality of the data processing carried out before the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR CONCERNED PERSONAL DATA UNLESS WE CAN PROVE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED IN ORDER TO ENGAGE IN DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).

Right of appeal to the competent supervisory authority

In the event of violations of the GDPR, those affected have a right of appeal to a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to yourself or to a third party in a standard, machine-readable format. If you request the direct transfer of data to another controller, this will only be done insofar as it is technically feasible.

Information, correction, and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to the correction or deletion of this data. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.

  • If the processing of your personal data occurred/is occurring unlawfully, you can request the restriction of data processing instead of deletion.

  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.

  • If you have lodged an objection according to Art. 21 Para. 1 GDPR, a balance must be struck between your interests and ours. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

4. Data collection on this website
Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version

  • Operating system used

  • Referrer URL

  • Host name of the accessing computer

  • Time of the server request

  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – the server log files must be recorded for this purpose.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, provided your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR) if this was requested; the consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Inquiry by email or phone

If you contact us by email or phone, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.

The data you send to us via contact requests will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Processing of customer and contract data

We collect, process, and use personal customer and contract data to establish, shape the content of, and amend our contractual relationships. We collect, process, and use personal data on the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6 Para. 1 lit. b GDPR.

The collected customer data will be deleted after the completion of the order or termination of the business relationship and the expiration of any existing legal retention periods. Statutory retention periods remain unaffected.

6. Audio and Video Conferences
Data processing

We use online conference tools, among other things, for communication with our customers. The tools we use in detail are listed below. If you communicate with us by video or audio conference via the Internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide/use to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants, and other "contextual information" related to the communication process (metadata).

Furthermore, the provider of the tool processes all technical data necessary to process the online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker, and the type of connection.

If content is exchanged, uploaded, or made available in any other way within the tool, this is also stored on the servers of the tool providers. Such content includes in particular cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options depend largely on the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the tools used, which we have listed below this text.

Purpose and legal basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Para. 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR). Insofar as consent has been requested, the use of the relevant tools is based on this consent; the consent can be revoked at any time with effect for the future.

Storage duration

The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory retention periods remain unaffected.

We have no influence on the storage period of your data, which is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.

7. Own Services
Handling applicant data

We offer you the opportunity to apply to us (e.g. by e-mail, by post, or via an online application form). Below we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data takes place in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we will process your associated personal data (e.g., contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 Para. 1 lit. b GDPR (general contract initiation) and – if you have given your consent – Art. 6 Para. 1 lit. a GDPR. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 Para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

Retention period of the data

If we are unable to make you a job offer, you reject a job offer, or you withdraw your application, we reserve the right to retain the data you submitted on the basis of our legitimate interests (Art. 6 Para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). Afterwards, the data is deleted, and the physical application documents are destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period expires (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

A longer retention can also take place if you have given corresponding consent (Art. 6 Para. 1 lit. a GDPR) or if statutory retention obligations preclude deletion.

8. Our Social Media Presences
This privacy policy applies to the following social media presences

Data processing by social networks

We maintain publicly accessible profiles in social networks. The social networks we use in detail can be found below.

Social networks such as Facebook, Twitter, etc. can usually analyze your user behavior comprehensively when you visit their website or a website with integrated social media content (e.g., like buttons or advertising banners). Visiting our social media presences triggers numerous data protection-relevant processing operations. Specifically:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data can also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.

With the help of the data recorded in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are logged in or were logged in.

Please also note that we cannot trace all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. Details on this can be found in the terms of use and privacy policies of the respective social media portals.

Legal basis

Our social media presences are intended to ensure the most comprehensive possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal bases to be specified by the operators of the social networks (e.g., consent within the meaning of Art. 6 Para. 1 lit. a GDPR).

Controller and assertion of rights

When you visit one of our social media presences (e.g., Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. You can basically assert your rights (information, correction, deletion, restriction of processing, data portability, and complaint) both against us and against the operator of the respective social media portal (e.g., against Facebook).

Please note that despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options depend largely on the corporate policy of the respective provider.

Storage duration

The data recorded directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory provisions – esp. retention periods – remain unaffected.

We have no influence on the storage duration of your data, which is stored by the operators of the social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g., in their privacy policy, see below).

Your rights

You have the right at any time to receive free information about the origin, recipient, and purpose of your stored personal data. You also have a right to object, to data portability, and a right of appeal to the competent supervisory authority. Furthermore, you can request the correction, blocking, deletion, and, under certain circumstances, the restriction of the processing of your personal data.
